Poker Tables | WPT Sued By Poker Stars

The company which operates the World Poker Tour (WPT), WPT Enterprises, Inc., has announced earlier today the settlement of a lawsuit which was brought against it by some huge poker stars such as Howard Lederer and Chris ‘Jesus’ Ferguson. At an earlier stage of the lawsuit, Greg Raymer and Joe Hacham were involved but they later pulled out before its conclusion.
The action revolved around the ‘player release’ form which is used at the world’s most famous poker tournament, the World Poker Tour. The poker players announced the lawsuit they were about to bring at a press conference which had been organised in Rio in Las Vegas during the 2006 World Series of Poker.
The result? The WPT’s ‘player release’ form has been modified in the poker player’s favour (athough there have been no damages awards).
Chris Ferguson, the leading spokesperson, said that he is happy that a fair agreement has been reached as to how poker stars’ images are used, both for current and future poker players who come to find themselves in the public eye.
The WPTE did not admit wrongdoing but said that it wanted to focus on growing the sport of poker rather than lengthy litigation.
So what is the lawsuit about and what is a ‘player release’ form? As it stood, the poker players argued, the form forced them to violate the other endorsement agreements and rights which they undertook with other companies. The form therefore stopped them from taking part in WPT poker events because they would be breaching their other contractual obligations.
The law involved was antitrust law and the players argued that the WPTE and others conspired , unlawfully, to eliminate competition. They also argued that it violated their intellectual property rights if the form stayed as it was.
