Germany Bans All Forms Of Online Gaming And Gambling At The Start Of 2008

Germany has seen in the New Year, not with champagne and a hangover (although most of them probably did that as well!) but with an extremely extensive online gaming ban. Thirteen or more of the sixteen German states have ratified a piece of legislation which bans any type of web-based gambling and brokering of online games.

German citizens will now no longer be able to play online poker in any of the online poker rooms which have sprung up on the internet over the past few years. Furthermore, they won’t be able to place bets online (even if the companies are based in other countries!).

Further provisions in the legislation ban the advertising of any form of internet gaming or gambling and even allows the federal governments to order the Internet Service Providers to physically block sites that offer these prohibited services (they can even actually block money transfers between the customer and the now prohibited gaming sites).

Obviously, it is clear that Personalpokerchip is against this sort of measure as we believe that it will force online gaming underground where it is more likely to damage those vulnerable consumers. We also don’t see anything wrong with gambling or betting per se, and hate the fact that the 99% who pursue this hobby legitimately are penalised because of the addiction of a few people. Surely resources would be better spent policing the game above ground and helping those vulnerable consumers with their addiction? It is also very likely that a draconian measure like this will be subject to legal challenges. Consider the EU implications with the free movement of services? How about the European Convention of Human Rights? Could one’s right to a private life cover this area? And if so, can it legitimately be overridden by the German Government in this case?

These are all questions which we hope to have answers to in years to come. Meanwhile let us all be grateful that we can continue to pursue online gaming and gambling in the UK!
